General Terms and Conditions

1. Purpose and Driver Requirements

1.1. This agreement governs the vehicle rental between Rodavante (Lessor) and the Client/Driver (Renter).

1.2. Driver: 23–75 years old. Mandatory presentation of valid original physical Identification Document (ID/Passport) and Driving Licence (held for more than 1 year). Copies, photographs or digital applications are not accepted. A physical embossed credit card in the driver’s name is required. American Express, debit, virtual or prepaid cards are not accepted.

2. Deposit, Payment and Cancellation

2.1. A pre-authorized security deposit between €1,000.00 and €2,100.00 is required depending on the vehicle group, released after inspection. Rental payment is due in advance upon delivery, plus the Mandatory Daily Usage Tax of €2.00/day (maximum 10 days per contract), pursuant to DLR No. 7/2025/M and Portaria No. 214/2026, of May 21.

2.2. Cancellation: up to 8 days before rental start – full refund minus €3.90; between 8 and 3 days – up to 3 rental days charged; less than 2 days or in case of No-Show – no refund. Contact: This email address is being protected from spambots. You need JavaScript enabled to view it..

2.3. Early returns will be recalculated at standard rates, with loss of any discounts. Extensions require at least 24 hours’ prior notice and express authorization from Rodavante.

3. Use, Fuel and Return

3.1. Compliance with the Highway Code is mandatory. Prohibited: driving by persons not identified in the contract, subleasing, professional transport of passengers or goods, participation in races or sporting events, and transporting animals.

3.2. The vehicle must be returned with the same fuel level as delivered. Missing fuel will be charged plus a refuelling fee (minimum €20.00). Excess fuel is non-refundable.

3.3. Delivery and collection are free of charge at Rodavante stations and nearby hotels during business hours. Airport, out-of-hours or other locations may be subject to specific fees.

3.4. Hidden damages (engine, clutch, gearbox, suspension) or defects not visible due to weather or dirt at the time of return may be charged after cleaning and inspection, with proof sent to the Client.

4. Insurance, Liability and Exclusions

4.1. The rental includes Mandatory Third-Party Liability Insurance (Generali/Tranquilidade, Policy No. 9841001521) and basic CDW (Collision Damage Waiver). All damages covered by CDW are subject to an excess, according to the vehicle group.

4.2. CDW covers all damages sustained by the rental vehicle, subject to an excess, and the absolute exclusions listed in clause 4.3. The following optional coverages may be purchased:

• SCDW – reduction or elimination of bodywork excess (dents and scratches);
• TCDW – waiver of liability for tyre and glass damages;
• PAI – personal accident insurance for passengers;
• TW – total theft coverage.

4.3. Absolute Exclusions

Damages not covered by any insurance, with the Client being 100% responsible for all repair and immobilization costs:

• a) Driving under the influence of alcohol or drugs, severe negligence, smoking inside the vehicle, subleasing or using the vehicle for professional transport;
• b) Participation in races or sporting events, or driving off paved roads (e.g., dirt or unclassified roads);
• c) Loss or damage to keys and remote controls; battery discharge caused by leaving lights or electrical equipment on;
• d) Damage to locks, interior, roof or undercarriage (subframe, engine, exhaust, suspension, steering) caused by road irregularities or ground-level obstacles (potholes, protrusions, rocks, speed bumps, etc.);
• e) Deep cleaning required due to stains, mud, greasy liquids, pet hair, strong odours or tobacco smoke;
• f) Loss, theft or damage to items or goods left, stored or transported inside the vehicle.

5. Accidents, Fines and Jurisdiction

5.1. In case of an accident, the Client must immediately contact the police and Rodavante and must not leave the scene. The European Accident Statement (DAAA) must be completed whenever applicable.

5.2. The Client is solely responsible for all fines, penalties, tolls and SCUTs incurred during the rental period. Credit card charges will only be made when duly documented and previously communicated to the Client.

5.3. Data Protection (GDPR): Rodavante is responsible for processing personal data collected for contract execution, which may be transmitted to judicial authorities, law enforcement, regulatory or tax entities to comply with legal obligations (e.g., identification for fines/tolls). 5.4. Portuguese Law applies. The exclusive competent jurisdiction is the Court of Funchal.
